New Spanish Rental Law Hits Thousands of Dutch: Investing in Own Country Becomes Increasingly Attractive
From April 4th, 2025, the letting of a second home in Spain to tourists has become significantly more difficult. The Spanish government has introduced a new law to improve the affordability of the housing market for locals. For Dutch vacation home owners in Spain, this has far-reaching consequences.
Tourist letting? Only with permission
From now on, anyone wishing to rent out a property in Spain to tourists must get explicit permission from three of the five co-owners within the building. No letting is allowed without this permission. And it's not without risk: fines can be as much as €600,000.
In addition, one runs the risk of being completely excluded from further rental activity, including if it was previously done legally without proper documentation or permits. The rules apply to all tourist landlords, including thousands of Dutch people who bought more than 4,000 Spanish homes in 2023.
